By downloading, installing, or using the Safety Check mobile application ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and SAP FACTORY, LLC ("we," "us," or "our"), the operator of Safety Check. By creating an account, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

To use Safety Check, you must register an account by providing your name, phone number, location, and the contact details of your designated emergency contact. You are responsible for ensuring this information is accurate and kept up to date.
By designating an emergency contact, you confirm that:
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorised access to your account.
You may delete your account at any time via Settings → Delete Account within the App. Upon deletion, all your personal data will be permanently removed within 30 days in accordance with our Privacy Policy.
You agree to use Safety Check only for its intended purpose and in compliance with all applicable laws. You must not:
The effectiveness of Safety Check depends on factors outside our control, including but not limited to: your emergency contact's availability, their response to the call or SMS, cellular network availability, GPS signal quality, and device battery status. We make no guarantee that your emergency contact will receive, answer, or act upon any alert.
By using Safety Check, you consent to receive automated push notifications, SMS messages, and phone calls as described in these Terms. These communications are necessary for the operation of the service.

You may stop all automated communications at any time by deleting your account via Settings → Delete Account. You may also adjust or disable push notification permissions in your device settings, though this will affect the App's ability to deliver check-in alerts.

Safety Check and all content, features, and functionality of the App — including but not limited to its design, text, graphics, logos, and software — are owned by SAP FACTORY, LLC and are protected by applicable copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or sublicense any part of the App.
Safety Check is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

We reserve the right to suspend or terminate your account and access to Safety Check at any time, with or without notice, if we reasonably believe you have violated these Terms or are using the App in a way that may cause harm to others.
You may terminate your account at any time by deleting it within the App (Settings → Delete Account). Upon termination, your right to use the App ceases immediately.
Sections 9 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) shall survive termination of these Terms.
These Terms are governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maryland, United States.
If you are a consumer in the EU or UK, nothing in these Terms affects your statutory rights under applicable consumer protection law in your country of residence.
We may update these Terms from time to time. When we make material changes, we will notify you by push notification and by posting the updated Terms in the App with a new "Last Updated" date. Your continued use of Safety Check after such notification constitutes your acceptance of the updated Terms.
